High Court quashes EWS reservation in AIQ, upheld OBC reservation

Madras(TN, India): Madras High Court has cleared that EWS reservation in All India Quota(AIQ) seats of medical and dental seats is impermissible without the approval of the Supreme Court, which has already fixed a 50% cap on the reservation.

The first bench of Chief Justice Sanjib Banerjee and Justice P D Audikesavalu has said that it is permissible to have 27 percent reservation for other backward classes in the All-India Quota (AIQ) for medical studies and has also added that AIQ need not follow 50 percent reservation as followed in the state.

“Centre’s July 29 notification was permissible only with respect to 15% reservation for Scheduled Castes, 7.5% for Scheduled Tribes and 27% reservation for Other Backward Classes (OBCs)”, HC added. 

However, the court has ordered that the Inclusion of 10% vertical reservation for the Economically Weaker Section would require the approval of the Supreme Court and to such extent, the reservation for EWS in Centre’s July 29 notification has to be recognized as impermissible till such approval is obtained.
