9th class student gets bail in SC-ST Act, spent 33 days in jail

Hathras(Uttar Pradesh): A 9th class student has been released on bail who was booked under the case of SC-ST ACT. Nearly one month after his arrest, the district court on Thursday granted bail to Ajay Kumar who was sent to jail in a Dalit atrocity case. Ajay Kumar was allegedly booked on the charges of molesting a Dalit girl.

The advocate of the alleged accused has debated that he was falsely framed due to ongoing political rivalry. Ajay Kumar’s elder brother was fighting for the local election and facing a political rivalry with the elected sarpanch.

While praying for bail, the lawyers argued that the case has no merit for the SC-ST Act as nowhere in the FIR the use of casteist slurs and caste based atrocity was mentioned.

The court observed that there was a two-day gap between the date of the incident and the FIR. It was also brought to the notice of the court that on the day of the incident Ajay Kumar was beaten by the father of the victim. The accused side has claimed that to save themselves the victim’s father implicated Ajay in a false case of the SC-ST Act. The medical reports of the alleged accused suggest the same things.

The accused was in jail from the next day of the FIR, i.e 14 May 2021, and released on bail on 17 June 2021.
