“Insult to Shri RamKrishna insults entire India”, HC grants bail to Dalit youth after 8 months

Prayagraj: Expressing anger over posting obscene posts against Bhagwan Shri Ram and Shri Krishna, the Allahabad High Court on Friday granted bail to a man booked for an FB post.

The Bench of Justice Shekhar Yadav was dealing with a bail plea of Aakash Jatav alias Surya Prakash, who made obscene remarks against Lord Ram and Krishna. The court granted conditional bail to the accused and warned him not to commit this crime again. The accused was in jail for the last 10 months. 

The petitioner said that on November 28, 2019, someone created a fake ID and posted an obscene post. He is innocent and also argued that freedom of expression is enshrined in the constitution. Which cannot be considered a crime. The public prosecutor said that the petitioner had gone to his uncle’s house in Ahmedabad. Where he has inserted his SIM card in the cousin’s mobile phone and posted obscene posts and as soon as the FIR is registered, he has thrown away the mobile phone and SIM card.

However, the court expressed anger over the arguments and said that freedom of expression is not unlimited. State security, spreading rumors, obscenity is not a freedom of expression but a crime.

India is incomplete without Shri Ram

 In the case of derogatory remarks on social media against Lord Rama and Krishna, the court said that India is incomplete without Ram. One who does not believe in religion can be an atheist. This does not give anyone the right to hurt the faith of others. The court quoted the Supreme Court as saying that dancing with a human skull in hand cannot be allowed.

Court explained Shri Ram and Shri Krishna to accused 

The honorable court glorified Shri Ram and Shri Krishna and explained this to the accused. Justice Yadav said that the principle of Karam Phal is explained in the Bhagavad Gita. The soul is immortal. She changes her body like clothes. Like a calf looking for its mother in its flock.

The mind is part of the body. Only the body feels pleasure and pain. Lord Krishna said, pay attention to the deeds, leave the fruits to me. The spirit of Vasudeva Kutumbakam is not found in any other country. Commenting on Ram Krishnan’s inability to be pardoned, the court said that God comes to protect religion. God incarnates when the religion is over. The image of Lord Rama Sita is also enshrined in the Indian Constitution. In such a situation, obscene remarks against Ram Krishna are unforgivable.
