Deoria(Uttar Pradesh): After spending around 8 years in jail, an SC-ST Act court acquitted two upper-caste men who were falsely accused of raping and impregnating a 23-year-old Dalit girl.
The case was lodged in 2013 when the girl along with her mother visited a local doctor with a complaint that she was not feeling well. The doctor found that the minor girl was six-month pregnant.
The girl, who is considered to be dumb, told her mother that she was raped by her two neighbors for the last six months. Her mother immediately lodged a first information report (FIR) and her statement was recorded before the magistrate. However, the girl had given birth to a baby. Sadly, the victim died after giving birth to the newborn.
During this duration, the blamed two men were put behind the bars and lastly taken for the DNA test. The DNA paternity test revealed that the accused were not the biological father of the baby.
Also, there were uncertainties between the statements of the deceased and her family members.
The court said it was clear that someone else had impregnated the girl. The judge further noted that the investigating officer was not able to conduct the preliminary inquiries.
Judge Arvind Ray concluded that the charges of gang rape and the SC-ST act could not be proved. Also, the DNA report indicates that the accused are not the biological parents of the newborn baby.
The judge said, “The prosecution has failed to prove that the accused are the persons who committed the offense. Hence, the court is acquitting the accused from all the charges”.
