Hathras: SC-ST Act court acquitted innocents in more than 92% of cases, most fake cases were linked to mutual rivalry

Hathras: After publishing three district-wise reports on the SC-ST Act we have come with our fourth report. This report, after Jaunpur, Saharanpur and Lalitpur, is also based on the decisions given by the SC-ST Court for which data from 1 January 2021 to 30 April 2021 has been included. We have analyzed the judgements given by the SC-ST court Hathras. During this time, 24 such cases were dealt with by the court which was related to SC/ST Act. In these 24 cases, the court found the allegations levelled to be correct in just 2 cases. In the other cases, the accused were acquitted.

Accused acquitted in 7-year-old case

Two young men were booked under IPC 323, 504 and SC/ ST Act by Govind, a resident of village Garhi Patti Banarasi. It was alleged by the applicant that the accused used casteist slurs also carry out the incident of assault. While dismissing the charges during the hearing, the court acquitted innocents of all the charges.

Fake Harassment case was made over transaction of money

Charan Devi accused his contractor and 4 other of assaulting and abusing. During the hearing, the SC/ST court found Rameshchandra Yadav, Vipin Kumar, Shivam Kumar and Sumandra Devi innocent and acquitted all the accused.

The court rejected the Complaint of assault and use of casteist word

On hearing of the cases filed by Gopal and Chandrasekhar on Mohan, the court dismissed the complaint and dismissed the incident as untrue. The court found that both of them live in the same house and due to mutual rivalry and pressure in an ongoing case, the case was registered.

Released from jail after 5 years, a case was filed against the applicant

Hearing case number 559/2016, Justice BD Bharti, in his order, acquitted 4 of the accused from serious charges. Finding the case of murder and SC-ST Act registered under the police station Sasni, the court has also ordered a case against the applicant. Jitu Singh, Deepak, Sachin and Suresh were booked under IPC 302, 506 and SC-ST Act.

Applicant went to court twice in a fake case and got FR canceled, while hearing court found the case factless

In 2011, the serious allegations of the SC/ST Act on Dev Sharma, Netrapal Sharma, Prem Prakash Sharma, Vimal Sharma were found to be false by the local police during their investigation. Which was revoked by the applicant by giving an application in court. On the orders of the court, the case was investigated by another police officer who again imposed FR in the year 2012. The report from the court was again quashed as demanded by the applicant. After which the trial of the case completed by the court and acquitted all the accused after about 10 years. The court, in its judgment on 9 April, found the case to be factless.

While giving judgment on about 24 such cases, the accused were acquitted in 22 cases by the court. At the same time, just two cases were found guilty by the court. Based on the decisions of the court, about 92 percent of the cases related to the SC/ST Act were found to be factless. Only 8 percent of the cases were found to be correct.
