Lucknow: Fifteen years after being charged under a case of the SC-ST act, the Hathras District Court acquitted two Rajput men of Hathras Junction police station in Hathras of all charges. As per the court order, Chandra Pal Singh had registered an FIR against Ram Babu and Bhuvnesh in 2007 citing the atrocity done by them based on his caste. In FIR, the complainant alleged that the duo had manhandled, abused, and beaten him on October 19, 2007. However, during the court trial, the case turned out in a land dispute matter in which the complainant registered the case to encroach on the disputed land.
‘No Medical Report’
The court has raised the concern about the medical report which was not added by the complainant. Also, the complaint, on many occasions, has changed his statements even in the courtroom. It was noticed by Justice Trilok Pal Singh that the witness had not also supported the claims of the complaint which made the ground for the acquittal of the accused.
What Did The Court Say
After adducing all the evidence, Justice Trilok Pal Singh said, “I have found that there are too many irreconcilable discrepancies in the evidence of the prosecution witnesses.” While the main witness was not trialled in court. Justice Singh said, “The matter also does not belong to the category which can attract the provisions of the SC-ST act.”
