Rajasthan(Bara): A Special court this week acquitted a 60-year-old man from charges of the SC-ST act in the Bara district of Rajasthan. The incident had occurred within Chabra police limits on September 7, 2015, when the alleged accused Amarla Gurjar had opposed the encroachment on his land.
According to the prosecution, on September 7, 2015, she along with her husband Daulatram went to the farm fields. The accused stopped him and started beating them by using casteist slurs.
On the application of the Daulatram, Chabra police had registered the FIR under IPC 341, 323, 504, and 3(1)X SC-ST act.
However, during the trial, The court held that the prosecution has misused their identity of being a Dalit and reported a false case of the Dalit atrocity. Special Justice Poonam Sharma said in her judgment that “Just to give a new color to the story, the identity of Scheduled Caste has been added to the case”.
“The prosecution has not even presented the true facts in the court but exaggerated stories have been made by them to file the case”, the court said while acquitting the man on charges of the SC-ST act.
